1 – General
These terms of sale apply to all orders placed on the website www.lesarcadiens.fr, published by:

The products offered for sale are decorative objects, designed and made in our workshop in Caen, France.
The terms for delivery, returns and data handling are set out on the following pages, which form an integral part of these terms:
2 – Definitions
(1) “Consumer” means any natural person acting for purposes outside their commercial, industrial, craft, professional or agricultural activity.
(2) “Customer” means any natural or legal person placing an order on the site.
3 – Formation of the contract
(1) The presentation of products on the website www.lesarcadiens.fr does not constitute a contractual offer but an invitation to order.
(2) The contract is formed when the customer receives the order confirmation email.
(3) The ordering process comprises the following steps:
- Choice of product, size and colour
- Adding to the cart
- Entering first name, last name and email address
- Choosing the Mondial Relay pickup point on the map
- Checking the summary: items, delivery charges, total
- Secure payment, operated by Stripe
The pickup point is chosen before payment: the amount shown on the payment button is the amount that will be charged.
(4) The customer may correct their details for as long as payment has not been approved. The order summary is emailed to them and kept by us.
(5) The site has no customer area: no account is needed to order.
4 – Prices, payment and terms
(1) All prices are shown in euros, all taxes included. Any delivery charges are added at the time of the order and displayed before payment.
(2) Payment is operated by Stripe Payments Europe, Ltd. The payment methods accepted are those presented on the payment page: card, and depending on your device and country, the electronic wallets offered by Stripe. Card details do not pass through our site.
(3) The order is processed once payment has been received.
5 – Delivery
(1) Orders are shipped to a Mondial Relay pickup point, with a tracking number. The pickup point is chosen by the customer when ordering. We do not offer home delivery.
(2) The countries served, the delivery charges, the dispatch times and the transit times are set out on the Delivery page, which is authoritative and kept up to date.
(3) The applicable dispatch time is the one shown on the product page and repeated at the time of the order. In the event of an exceptional volume of orders making it impossible to meet, Les Arcadiens will inform the customer by email of the new estimated time. The customer may then cancel their order and be refunded in full, with no justification and no charge.
(4) Delivery times are given as an indication. Under article L216-2 of the French Consumer Code, where they are exceeded by more than 30 days after the order, the contract of sale may be terminated by the buyer, who will be refunded in full.
(5) The tracking number is emailed as soon as the parcel ships. It allows the journey to be followed on the Mondial Relay site (https://www.mondialrelay.fr/suivi-de-colis/).
(6) The customer has the availability period stated by Mondial Relay to collect their parcel from the pickup point selected. After that period the parcel is returned to us and the customer is informed.
(7) Under article L216-4 of the French Consumer Code, the risks associated with carriage are borne by Les Arcadiens until the parcel is actually handed over to the customer.
The customer is invited to check the condition of the parcel on receipt. In the event of an anomaly (damaged parcel, broken or missing product), any claim must be sent within 3 working days to contact@lesarcadiens.fr, with photographs in support where possible.
(8) In the event of a temporary closure of the workshop (holidays, maintenance), processing and dispatch times may be extended. A visible message stating the period concerned is then displayed on the site, and the customer may cancel their order if they do not wish to wait.
6 – Retention of title
Les Arcadiens retains ownership of the products sold until the price has been paid in full by the customer.
7 – Right of withdrawal
The customer has 30 days from receipt of the order to exercise their right of withdrawal, without having to give a reason. This period is more favourable than the 14 days provided for by article L221-18 of the French Consumer Code.
To exercise it, the customer has an online withdrawal form, reachable from the footer of the site. It records the date of the request and immediately sends an acknowledgement by email.
The customer may also notify their decision by email to contact@lesarcadiens.fr, stating their order number: a clear statement expressing the wish to withdraw is sufficient and has the same effect.
The terms of the return, who bears the cost depending on the country and the return address are set out on the Returns and refunds page.
Products must be returned in perfect condition, unused, in their original packaging.
Les Arcadiens will refund all payments received, including the standard delivery charges paid on the way out, within a maximum of 14 days from receipt of the returned items or from proof of their dispatch. The refund is made to the same payment method used for the purchase.
8 – Faulty products and claims
In the event of a faulty product or a delivery error, please contact contact@lesarcadiens.fr within 30 days. If the fault is confirmed, Les Arcadiens covers the return costs and offers an exchange or a refund, at the customer’s choice.
The customer also benefits from the statutory guarantee of conformity (articles L217-3 et seq. of the French Consumer Code) for 2 years from delivery of the goods, and from the guarantee against hidden defects (articles 1641 et seq. of the French Civil Code). These guarantees are free of charge and apply independently of the right of withdrawal.
9 – Product characteristics
The objects are made from bio-based PLA by 3D printing. This method entails visible striations and slight irregularities that are part of the craft character of the product.
Our PLA objects are designed for indoor use. They must not be exposed to a temperature above 40 °C, to prolonged direct light, nor come into contact with water. A watertight insert may be supplied with the object depending on its intended use. We recommend using it and checking that it is watertight before each use.
Product colours may differ slightly from the images shown on screen. Les Arcadiens cannot be held liable for display variations arising from the calibration of your screen or the settings of your equipment.
10 – Liability
Les Arcadiens accepts no liability for:
- improper use of the objects,
- damage caused by poor care or storage,
- indirect losses.
Liability is limited to direct damage caused intentionally or by gross negligence. This limitation does not apply in the event of harm to life, physical integrity or health, nor to the statutory guarantees mentioned in article 8.
11 – Personal data
Personal data is collected solely for the purpose of managing orders, in accordance with our privacy policy.
12 – Governing law and mediation
These terms are governed by French law. In the event of a dispute, an amicable solution will be preferred: we invite you to write to us first at contact@lesarcadiens.fr.
Under article L612-1 of the French Consumer Code, every consumer has the right to free recourse to a consumer mediator with a view to settling a dispute amicably. Failing agreement, the French courts shall have jurisdiction. As a consumer you nonetheless keep the mandatory protections of the law of your country of residence and may bring proceedings before the courts of your domicile.
13 – Intellectual property
Les Arcadiens is a registered trade mark. The object designs offered are original creations protected with the INPI (French National Institute of Industrial Property). Any reproduction, copy or exploitation without authorisation infringes intellectual property rights.
All elements present on the website www.lesarcadiens.fr — whether photographs, objects, designs, logos, images, videos or text — are and remain the exclusive intellectual property of Les Arcadiens – Geoffrey Kazmierczak.
No one is authorised to reproduce, exploit, redistribute or use these elements in any capacity whatsoever, even partially, without prior written authorisation.
Any unauthorised use may constitute infringement, punishable under articles L.335-2 et seq. of the French Intellectual Property Code.
14 – Governing language
This version is a translation. In the event of any discrepancy between language versions, the French version prevails. As a consumer you nonetheless keep the mandatory protections of the law of your country of residence.
